DMCA Take Down Procedure

  1. Infringement Notification

To file a notice of infringement, provide a written communication that includes the information listed below. Please be aware that you may be liable for damages if you misrepresent that material is infringing. If you are unsure about your claim, consult a lawyer.

Please follow this format:

  1. Counter Notification

The provider of the allegedly infringing content may file a counter notification under sections 512(g)(2) and (3) of the US Copyright Act. If you do so, please follow this format:

  • Identify the material that was removed or disabled and where it appeared before removal.
  • Provide your name, address, and telephone number.
  • Include the statement: “I consent to the jurisdiction of Federal District Court for the [insert the federal judicial district where your address is located].”
  • Include the statement: “I will accept service of process from [insert the name of the person who submitted the infringement notification] or their agent.”
  • Include the statement: “I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled due to a mistake or misidentification.”
  • Sign the document with your physical or electronic signature.

Once we receive a proper counter notification, we will inform the original complainant and restore the material unless we receive notice that legal action has been taken to prevent its restoration.

  1. Repeat Infringers

In line with Section 512(i)(1)(a) of the DMCA, we will, in appropriate circumstances, disable and/or terminate the accounts of repeat infringers.
